New York State just revamped its traffic laws, and it’s a big deal for everyone, especially frequent drivers. These changes affect:  

  • How many points you get on your license for violations
  • The penalties
  • How to get your license back if it’s suspended 

The rules are tougher now, so being informed is crucial.

Expanded Look-Back Period: The New York State Department of Motor Vehicles (DMV) now reviews your driving record over the past two years (24 months), rather than the previous 18 months. This means older violations could now impact your record. Important Note: The application of this change to existing versus new violations isn’t entirely clear and could pose challenges for some drivers.

Construction Zone Speeding: Speeding in a construction zone now carries an automatic 8-point penalty, regardless of the speed. Previously, the point assessment depended on how far over the speed limit you were driving. This is a substantial increase in penalties.

DUI and Related Offenses: Driving under the influence of alcohol or drugs (DWI, DWAI, etc.) now results in 11 points on your license. While these points may not immediately trigger a suspension for a first-time DUI, other penalties will apply, and later offenses will accumulate points rapidly. Significant fines are also associated with DUI convictions.

Revised Point Values for Other Violations: Several violations now carry points for the first time, and the point values for other offenses have been increased. Examples include:

  • Driving with a Suspended License: 11 points (NEW)
  • Aiding Someone Driving with a Suspended License: 5 points (NEW)
  • Racing: 5 points (NEW)
  • Passing a Stopped School Bus: 8 points (Previously 5)
  • Careless Driving: 5 points (Previously 2)
  • Leaving the Scene of an Accident with Injuries: 5 points (Previously 3)

Accumulating Points Leads to Consequences: Too many points will result in warning letters, mandatory driver improvement courses, and potential suspension hearings. A hearing is mandatory if:

  • You accumulate 11 or more points within two years.
  • You accumulate 9 or more points from speeding within two years.
  • You accumulate 4 or more points within a year of a previous hearing.

Even if you don’t reach the point threshold, multiple violations within a short period could trigger a hearing.

DMV System Lag: While the new regulations are in effect, the DMV’s computer system has not yet been updated. The process for tracking points during this interim period is unclear, so extra caution is advised.
