In New York City, keeping your apartment warm and having readily available hot water are essential for comfortable living. But did you know there are laws and helpful programs in place to guarantee these necessities for tenants?
Hot Water
- Landlords are required to provide hot water 365 days a year.
- The minimum hot water temperature must be 120 degrees Fahrenheit at the faucet.
Heat
- Landlords are required to provide heat between October 1 and May 31.
- During this period, the minimum indoor temperature must be:
- 68 degrees Fahrenheit between 6:00 AM and 10:00 PM.
- 62 degrees Fahrenheit between 10:00 PM and 6:00 AM.
- If the outside temperature falls below 55 degrees Fahrenheit between 6:00 AM and 10:00 PM, the indoor temperature must still be maintained at 68 degrees Fahrenheit.
What to Do If You Have Heat and Hot Water Problems
If you experience problems with your heat and hot water, you should first let the superintendent, property manager, or building owner know. If the problem is not solved, or the people you told are unresponsive, report the issue by calling 311.

If You Need Help With Heating Bills
The Home Energy Assistance Program (HEAP) helps low-income homeowners and renters pay for utility and heating bills. The allocations for the 2023-2024 HEAP Regular Benefit opened on November 1, 2023, and will run until funding runs out.
There is no set end date for applications; this means it’s important to apply as soon as possible to increase your chances of receiving assistance.
If you are eligible, you can get one regular HEAP benefit per program year and could also be eligible for emergency HEAP benefits if you are in danger of running out of fuel or having your utility service shut off.
Eligibility and benefits are based on:
- Income
- Household size
- Primary heating source
- The presence of a household member who is under age 6, age 60 or older, or permanently disabled.
